Guardian Data Destruction Successfully Expands Legal Options for New Jersey Businesses:
Garden State Companies Now Given More Choice Regarding Hard Drive Destruction
(South Hackensack, NEW JERSEY) On January 11, 2016, New Jersey Governor Chris Christie signed PL 2015, c. 188, a law giving New Jersey businesses more choice on hard drive destruction. The state’s actions mark the culmination of a nearly two-year campaign spearheaded by Guardian Data Destruction and other key industry groups to remove what many considered an arbitrary limitation.
The new legislation removes the state’s restriction on mobile hard drive shredding, thereby enabling the New Jersey businesses to more thoroughly and quickly implement and comply with their data protection requirements.
“Guardian services businesses nationwide, and we saw how this limitation held back New Jersey businesses from meeting key compliance obligations--thereby putting them at potential competitive disadvantage,” explained Glenn Laga, Guardian’s President and Cofounder. “We are headquartered in New Jersey, and felt passionately about helping our local customers. For the past two years, we have prioritized working on behalf of these businesses so that legislators would make a change.”
“We were first approached by Guardian Data Destruction, a New Jersey-based NAID (National Association for Information Destruction) member who had already had done considerable groundwork on the initiative,” said NAID CEO Bob Johnson. “When Guardian made us aware of the opportunity for meaningful change, there was already considerable momentum behind it.”
“NAID applauds the actions of the New Jersey lawmakers in providing their constituents with more discretion in deciding what hard drive destruction solution is best for them,” said Adamson. “As a result, they now have more than 20 mobile data destruction service providers to choose from, where before they had only a few.”
Guardian and NAID also credits the Commerce and Industry Association of New Jersey (CIANJ) for their work on the project. “Anyone who has dealt with these issues knows they are difficult to navigate. The CIANJ team, led by Anthony Russo, did a great job guiding the initiative through those challenges.”
The new law does require service providers to be NAID AAA Certified, which was included at the insistence of lawmakers to validate certain vendor qualifications. There are currently an estimated 24 service providers capable of providing NAID Certified mobile destruction on hard drives to New Jersey customers.
NAID is currently working with the New Jersey Department of Environmental Protection to provide an efficient method for field investigators to validate service provider qualifications. More information will be provided on that aspect
